Privacy Policy
How RK Assurance collects, uses, and protects your personal information, in plain language.
1. Who we are
RK Assurance is a damage insurance brokerage (cabinet) licensed by the Autorité des marchés financiers (AMF) in the province of Québec. We are based at 247 Av. Dunbar #202, Mont-Royal, QC H3P 2H4.
This Privacy Policy explains what personal information we collect, why we collect it, how we use it, and what rights you have under Québec’s Act respecting the protection of personal information in the private sector (Law 25, formerly Bill 64) and applicable Canadian privacy law.
2. What we collect
Depending on how you interact with us, we may collect:
- Identity and contact information: name, address, phone, email, date of birth, language preference.
- Insurance-related information: driving history, vehicle details, property details, claims history, current and prior coverage.
- Financial information: banking details for premium payment, where applicable.
- Website information: IP address, browser type, pages visited, and analytics data via cookies (see our Cookie Policy).
3. Why we collect it
We collect personal information to:
- Provide quotes and place insurance coverage on your behalf with our insurer partners.
- Service your policy, including renewals, endorsements, and claims advocacy.
- Comply with our legal and regulatory obligations as an AMF-licensed brokerage.
- Communicate with you about your coverage, our services, and (only with your consent) marketing.
4. Legal basis
We process your personal information based on:
- Your consent, which you give when you request a quote, accept our services, or submit information through our website.
- Performance of a contract, the brokerage agreement under which we place and service your insurance.
- Legal obligations, including AMF record-keeping requirements.
5. How long we keep it
We retain client files for a minimum of seven (7) years after the end of the brokerage relationship, in accordance with AMF rules and applicable insurance regulations. Some records may be kept longer where required by law (for example, in connection with an open claim or litigation). Web analytics data is kept for up to twenty-six (26) months unless you object.
6. Who we share it with
We share your personal information only with:
- The insurer(s) we approach on your behalf to place or service your coverage.
- Service providers under contract who help us operate (for example, our hosting provider, our email infrastructure, our policy management system). These providers are bound by confidentiality and data-protection obligations.
- Regulators and authorities when required by law (AMF, courts, tax authorities).
We do not sell or rent your personal information to anyone.
7. Your rights
Under Québec law, you have the right to:
- Access the personal information we hold about you.
- Rectify information that is inaccurate, incomplete, or out of date.
- Withdraw your consent to certain uses of your information, subject to legal and contractual constraints.
- Request deletion of your information once we no longer have a legal basis to keep it.
- File a complaint with us first, and, if unresolved, with the Commission d’accès à l’information du Québec.
8. Cross-border storage
Our website and core business systems are hosted in data centres located in Toronto, Canada. Some service providers (for example, email infrastructure) may process data outside Québec or Canada under contractual safeguards consistent with Québec law.
9. Security
We protect your personal information with technical, physical, and organizational safeguards proportionate to its sensitivity, including encrypted connections, access controls, malware protection, and staff training.
10. Changes to this policy
We may update this Privacy Policy from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Material changes will be communicated to active clients by email.
